If the person is found guilty in the court, his criminal defense attorney will do his best in order to save his client for being convicted for that particular crime.
If you work as the public defender then the client will be appointed to you. You’ll need to meet the client for the judicial matters relating to the crime for which he is being accused. You need to discuss all the details related to the case and the facts associated with the plea which has to be presented to the judge. After this, you will have time to carry out the necessary investigations, review the police reports and examine the evidence to get prepared for the trial.
Both parties present their witnesses during the trial process. Most of them are experts. After the trial the prosecution asks questions of the person on stand. The defense attorneys have authority to cross examine with various questions.
During the trial process or before the start of the trial, the defense attorneys can make an attempt to resolve the matter out of court. The criminal defense attorney may choose to either to accept the offer of settling out of court or simply turn it down. In any case you are required to consult with your client.
Once the witnesses have answered and the necessary evidence has been presented, the next step is the closing argument. The defense attorney summarizes all the facts in front of the jury and the jury gives their final judgment.
How much time will be taken by the jury to declare a judgment cannot be estimated. Sometimes a jury takes less than an hour in announcing a verdict while sometimes it takes several days to announce the verdict. If the verdict is not guilty then the client is free. On the other hand if the verdict is found to be guilty the client can appeal to a higher court.
If you are a defense lawyer and have your own independent criminal defense law firm, the same procedure is followed. The only difference is that the client will approach you directly. You can also charge a significant fee if you are practicing as a criminal defense attorney privately.
How you charge fees is totally at your discretion. You can ask for flat fees directly or charge on an hourly basis.
If you have too much work and are unable to handle the case of a client who has approached you, simply suggest he find another attorney as you won’t be able to devote sufficient time and effort to this client’s case.
